These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AfterCall LLC, a California limited liability company ("AfterCall," "we," "us," or "our"), governing your access to and use of the AfterCall mobile application, website, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

However, use of the Service does not require professional credentials, and we do not verify professional licensure.
You may create an account using an email address and password, or through anonymous authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to use the Service only as a personal reflection and wellness tool, not as a clinical or operational record.
THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. All content, features, AI-generated outputs, and information available through the Service, including but not limited to:
are provided for informational, educational, and personal reflection purposes only and do NOT constitute medical advice, diagnosis, treatment recommendations, or professional consultation.
You must NOT rely on the Service for clinical decision-making. Always consult with qualified healthcare professionals, your medical director, your employer's protocols, and established clinical guidelines for any clinical question, treatment decision, or patient care matter.
The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You agree NOT to enter, upload, transmit, or share any Protected Health Information (PHI) through the Service.

When logging calls or reflections, you should use only general descriptions, demographic categories (e.g., "adult," "geriatric"), and non-identifying details. References to patients should be entirely anonymous.
AfterCall is NOT a HIPAA-covered entity and the Service is NOT HIPAA-compliant. Entering PHI into the Service may violate HIPAA, state privacy laws, your employer's policies, and these Terms.
You are solely responsible for ensuring that any information you enter into the Service complies with all applicable privacy laws, professional obligations, and employer policies. You agree to indemnify and hold AfterCall harmless from any claims arising from your entry of PHI or other prohibited information.
To help enforce the prohibition on PHI, AfterCall employs a layered, automated content safeguard system that applies to content submitted through community features, shared call narratives, and AI-assisted inputs. By using the Service, you acknowledge and consent to the operation of these systems, which include:
These systems are designed to reduce PHI exposure but are not a substitute for your own responsibility to avoid entering PHI. Automated systems may produce false positives (flagging non-PHI content) or false negatives (failing to detect all PHI). AfterCall makes no guarantee that all PHI will be detected or prevented from transmission.
Content determined by AfterCall administrators to contain PHI or to violate these Terms may be removed without notice. Repeated violations may result in account suspension or termination pursuant to Section 10.3.
New accounts (those less than seven days old) are subject to enhanced moderation: community posts from new accounts default to a pending review state and are not publicly visible until approved by an administrator.
The Service includes wellness, journaling, and reflection features intended for general personal wellness. The Service is NOT a substitute for professional mental health care, therapy, counseling, or crisis intervention.
If you are experiencing a mental health emergency, suicidal thoughts, thoughts of self-harm, or thoughts of harming others, DO NOT use the Service for help. Instead, contact emergency services immediately:
AI-generated content, including AfterCall AI insights, reflections, and chat responses, is generated by automated systems and may contain inaccuracies, errors, or inappropriate suggestions. AI features are not equivalent to interaction with a qualified mental health professional, peer support specialist, or crisis counselor.
Community features that allow you to connect with other users, including peer support functionality, are facilitated by other users who may not have professional mental health credentials. Peer support conversations through the Service are NOT confidential in the legal or therapeutic sense and should not be relied upon for crisis intervention or professional mental health care.
We strongly encourage all EMS professionals to seek qualified professional mental health support, especially after critical incidents, traumatic calls, or periods of elevated stress. The Service is designed to complement, not replace, professional care.
AfterCall offers a free tier with basic features and a paid "AfterCall Pro" subscription tier with additional features. The specific features available in each tier are described in the Service and may change at our discretion with reasonable notice.
Prices are subject to change with notice. Local taxes may apply.
SUBSCRIPTIONS AUTOMATICALLY RENEW. Your AfterCall Pro subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscriptions are processed through the Apple App Store (for iOS users) or Google Play Store (for Android users). Payment will be charged to your iTunes or Google Play account at confirmation of purchase.
You may cancel your subscription at any time:
Cancellation will take effect at the end of the current billing period. You will retain Pro access until that time. No refunds or credits are provided for partial months or unused time.
Refund requests are handled by Apple or Google according to their respective policies. AfterCall does not directly process refunds for subscription purchases.
We may offer free trials or promotional pricing from time to time. If a free trial is offered, you will be charged the regular subscription fee at the end of the trial unless you cancel before the trial ends.
We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will provide reasonable notice of any price changes.
"User Content" includes any information, text, journal entries, call logs, reflections, photos, or other materials you submit to the Service. You retain all ownership rights in your User Content.
By submitting User Content to the Service, you grant AfterCall a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, transmit, display, and distribute your User Content solely for the purposes of:
This license terminates when you delete your User Content or your account, except where retention is required by law or for legitimate operational purposes (e.g., backups, fraud prevention).
Content you choose to share publicly or with communities (including shared calls, posts, comments, and chat messages) may be visible to other users. You are solely responsible for content you choose to share, and you should never share PHI or content that violates the privacy rights of others.
When you share content to communities or the public feed, you grant other users a license to view, comment on, and interact with that content within the Service.
If you choose to share content anonymously, your name will not be displayed alongside the content. However, anonymity is not guaranteed against technical, legal, or forensic analysis. Do not assume anonymous sharing provides absolute privacy.
Content generated by AfterCall AI features (narratives, insights, summaries, suggested questions, etc.) is owned by you for personal use. However, you acknowledge that:

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, removal of content, and may be reported to law enforcement or other authorities where appropriate.
The Service, including all software, designs, logos, trademarks, content (excluding User Content), and other intellectual property, is owned by AfterCall LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, AfterCall grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use.
"AfterCall," "AfterCall AI," the AfterCall logo, and related marks are trademarks of AfterCall LLC. You may not use these marks without our prior written permission.
If you provide AfterCall with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your Feedback into the Service without any obligation or compensation to you.
The Service integrates with and uses third-party services, including but not limited to:
Your use of these third-party services is subject to their respective terms and privacy policies. AfterCall is not responsible for the availability, accuracy, or content of third-party services.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.
Your data is stored on cloud infrastructure (currently provided by Supabase). While we implement reasonable security measures, no method of electronic storage is 100% secure.
You are responsible for maintaining your own backups of important data. AfterCall is not responsible for any loss of data.
You may request deletion of your account and associated data at any time through the Service settings or by contacting support. Some data may be retained for legitimate operational purposes (backups, fraud prevention, legal compliance) for a limited period after deletion.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
AFTERCALL DOES NOT WARRANT THAT:
NOTHING IN THE SERVICE CONSTITUTES MEDICAL, LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. YOU ASSUME FULL RESPONSIBILITY FOR ANY USE OF INFORMATION OBTAINED FROM THE SERVICE.
WE ARE NOT RESPONSIBLE FOR CONTENT POSTED BY OTHER USERS OR FOR THIRD-PARTY CONTENT ACCESSIBLE THROUGH THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

YOU ACKNOWLEDGE THAT THESE LIMITATIONS OF LIABILITY ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND AFTERCALL AND THAT WITHOUT THESE LIMITATIONS, AFTERCALL WOULD NOT PROVIDE THE SERVICE.
You agree to indemnify, defend, and hold harmless AfterCall LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
We may revise these Terms from time to time. The most current version will be posted in the Service and on our website. If a revision is material, we will provide reasonable notice (such as through the app or by email). Your continued use of the Service after the effective date of any changes constitutes acceptance of those changes.
You may stop using the Service and delete your account at any time through the Service settings.
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice, including for violations of these Terms.

Before filing any formal claim, you agree to attempt to resolve any dispute by contacting us at jordan@aftercallapp.com and describing the issue. We will attempt to resolve the dispute informally within thirty (30) days.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in San Francisco County, California, or another mutually agreed location, in English.
YOU AND AFTERCALL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
The arbitration agreement does not apply to:
You may opt out of the arbitration agreement by sending written notice to jordan@aftercallapp.com within thirty (30) days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco County, California.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and AfterCall regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
We will not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemics, government actions, or infrastructure failures.
Notices to you may be provided through the Service, by email to your registered email address, or by posting on our website. Notices to AfterCall should be sent to jordan@aftercallapp.com or to AfterCall LLC at California.
